Algemene voorwaarden en privacyverklaring

Als lid van The Daily CrossFit ben je akkoord met de algemene voorwaarden en privacyverklaring van The Daily CrossFit en de privacyverklaring van SportBit manager. Kijk regelmatig of er nieuwe versies zijn. Let daarbij op de publicatiedatum. Wij zullen ons best doen wijzigingen ook apart aan te kondigen.

Terms and Conditions

On all agreements concluded by The Daily CrossFit only Dutch law is applicable. Each athlete is required to take cognizance of the general regulations of The Daily CrossFit.

1.2 Agreement

These conditions apply to all service of The Daily CrossFit. The Daily CrossFit is entitled to change the membership conditions applicable. The changes shall take effect one calendar month after the publication, unless a different legal deadline is required, which is then applied. If a member does not wish to accept a change, he can terminate his membership from the date on which the new conditions take effect. The request for cancellation must be received by The Daily CrossFit one month prior to the effective date of the change. The request for cancellation must be made in writing or by email, but the final cancellation can only be done in person during a termination conversation.

2.1 Membership
I am familiar with the fact that I enter into my membership for the agreed contract duration. The start date is chosen on the registration form. For each subscription, a notice period of one month applies, after the contract duration originally agreed on. Subscriptions are paid in advance for a whole month. Membership is strictly personal and can be transferred only with the consent of The Daily CrossFit.

The memberships are a monthly, 3 months and one year contract when first activated, thereafter there is a month to month subscription.

If I do not cancel my membership in writing one calendar month prior to the end date of the contract, the membership will be automatically extended after the expiry of the original contract duration for an indefinite period with a notice period of one calendar month. After the expiry of the contract duration, the contract is automatically converted into a monthly subscription.

2.2 Pausing
Injuries
In the case of long-term injuries, we’re happy to help in the rehabilitation process. If you have an injury, we recommend that you go ahead working together with your coach. In combination with the exercises you get from a doctor or physiotherapist we want to help you so that you as quick as possible get fit and strong again.

Holidays: Shorter than 4 Weeks
In case of a holiday shorter than four weeks, we cannot pause your subscription. We would like to give some tips and training advice, so that you can maintain your fitness during your holiday.

Holidays: 4 Weeks or Longer
In case of a holiday longer than 4 weeks, you’ll be able to pause your subscription under the following conditions:

  • The pause for a predefined period.
  • The pause can never be with retroactive effect.
  • The pause can only start from the first day of the following month.
  • The termination must be requested at least one calendar month in advance.
  • Your subscription will automatically again be resumed after the pause. Please remember this yourself.
  • During the pause you will have to pay a break subscription of €20, – per month:
     

- You will remain a member of the community.
- You’ll get tips and a holiday workout program in consultation with your coach.
- During your holiday, we are ready to provide you with advice if necessary.

Illness
In the event of a prolonged (more than 4 weeks) injury or harm because of which you absolutely cannot and are not allowed to do fitness, the membership can be temporarily stopped with the consent of The Daily CrossFit (except for e.g. study, internship, work and holidays). The discontinuation cannot be retroactive and shall become effective on the first day of the following month. The discontinuation must be requested at least one calendar month in advance.

2.3 Membership Fees
In case of cash payment or bank transfer the entire subscription period, including registration fee, has to be paid in advance. If, the subscription is renewed, the due amount has to be paid no later than 7 days before the beginning of the new period. If payment of the subscription fee is done by means of direct debit, it will be performed on the last day of the month prior to the current month. At the time of the collection you must provide for sufficient funds in your bank account. In case of late payment, all outstanding installments for the remainder of the membership are due and must be paid within 30 days after due and payable by the member of The Daily CrossFit. The member cannot participate in training until the time that his debts due are paid. If, The Daily CrossFit, should have to collect its claim on the member, the member shall also pay all extrajudicial costs and statutory interest. When, The Daily CrossFit has started collecting its claim the member cannot use the club until the moment all through The Daily CrossFit charged costs are paid. The agreed registration and administration costs must be paid by direct debit.

If, the membership is activated earlier than the effective date of the contract and thus the member can use the facilities from The Daily CrossFit a few additional days, the member must pay an additional subscription fee, calculated in proportion to the number of additional days. The member shall never be entitled to a refund of membership fees.

All prices include VAT. The Daily CrossFit is entitled at any time to adjust its prices in case of changes in the level of VAT rates.

2.4 Termination of Membership
In case of termination, the end date is on the same day of the month as the start date, in compliance with the contract duration and the one-month notice period. For example, if you terminate your membership any day during the month of May you will still pay for one more month (June).

The request for cancellation must be made in writing or by email, but the actual withdrawal can only be done in person during a termination conversation. To ensure the proper receipt of the cancellation letter The Daily CrossFit recommends sending it by registered post. Premature termination of the contract by the club member is only possible on medical grounds where a doctor’s certificate is required.

3.1 Subscriptions
With all subscriptions, you can train the specified number of times per week. Unused workouts cannot be transferred to the next week. You are required to register for the training via the registration system of SportBit.

3.2 Personal Training
The Daily CrossFit offers private tutoring in the form of Personal Training at an additional charge.

3.3 Punch Cards
The Punch card is personal and not transferable. The validity is indicated in the personal SportBit online account. The number of visits should be made within the applicable period. Any outstanding visits expire at the end of the period.

4.1 Opening Hours
The Daily CrossFit is authorized to close the gym during public holidays and school holidays. The Daily CrossFit is authorized to temporarily or permanently change the opening hours of the gym. The Daily CrossFit is authorized to close the gym for repair and maintenance work. If this closure is for less than 24 hours, the member shall not be entitled to a refund of membership fees.

4.2 Participation in Training
In order to be able to participate in the training, the member must register at least one hour before the start of the training. The registration goes through the SportBit platform. We apply a maximum number of participants for each lesson.

4.3 Cancellation Participation Training
Due to the limited number of training places one has to carefully deal with reserving training. The member must unregister at least 1 hour before the start of the training if he or she will not be present or cannot be present on time.

5.1 Privacy
The Daily CrossFit acts in accordance with the provisions of the law concerning the protection of personal data of December 8, 1992. The company is responsible for processing your data. Your personal data will be included in our member database and processed: for the management of the customer base and the presented products and services, to carry out market research to inform you about new products and services for the realization of the information and promotion campaigns. Your data will not be transferred to third parties without your personal consent.

5.2 Personal Data
Changes in the personal situation of the member (e.g. address or bank details) should be passed directly to The Daily CrossFit. When not passing on these changes and when The Daily CrossFit incurred expense necessary to identify the new personal data, these costs will be charged to the member.

6.1 Liabilities
The Daily CrossFit, trainers and or other agents are not liable for material or immaterial damage caused by an accident or injury of the member and/or third parties, irrespective of how the damages came about, except in cases of wilful misconduct or gross negligence on the part of The Daily CrossFit or its executives.

The Daily CrossFit, trainers and/or other agents are not liable for damage, loss or theft of property of the member and/or third parties, except in cases of wilful misconduct or gross negligence on the part of The Daily CrossFit or its management.

The use of the equipment, following a program or course components and/or activities of any kind at The Daily CrossFit, is entirely at the own risk of the member.

Each member himself/herself is responsible for personal accidents and his/her belongings. You are advised to insure yourself accordingly. Ask for more information at your insurance broker. Neither the company nor its employees can be held responsible for loss, damage or theft of goods within the territory of the club. Every athlete or visitor is liable for the damage caused by him/her to the property of The Daily CrossFit.

6.2 House Rules
The member may train during opening hours in the box, in compliance with the applicable house rules. These rules are present in the box. The Daily CrossFit can at any time refuse or deny access to any person whose conduct justifies this decision.

In sports areas you must at all times be dressed in proper sportswear. Wearing clean shoes is mandatory.
The changing rooms and showers must be left clean after use.

It is not allowed to use drugs, alcohol or smoking materials inside the gym. Use of such substances will lead to the immediate termination of the subscription, without any right of refund of subscription fees already paid. You must adhere to the instructions and regulations laid down by The Daily CrossFit regarding, among other, garments, necessary order and discipline. In case of violation of these instructions and/or regulations The Daily CrossFit may deny you access to the gym and end the subscription immediately without this leading to a reduction in subscription fees or restitution.

6.3 Compliance to Agreement
The subscriber certifies by signing the membership agreement to comply with the house rules and terms and conditions established by The Daily CrossFit and to execute the instructions. The Daily CrossFit is entitled at any time to deny access to anyone who does not abide by the rules for a by The Daily CrossFit determined period, without any right on refund of subscription fees already paid.

6.4 Other Provision
All cases and/or situations not provided for in the above regulations are solely judged by and decided on by the management of The Daily CrossFit.

6.5 Final Provision
Agreements between the Member and The Daily CrossFit can only be made in writing, and may only be amended in writing. If any of the above provisions is invalid or unlawful, the remaining provisions shall maintain their validity.
